About these terms
These terms apply to every purchase of goods from Natulivo LLC, 17 Harbor Lane, Bar Harbor, ME 04609, United States, email [email protected], telephone (207) 555-0148 ("we", "us"). Guided trips are covered separately by our Booking & Cancellation Policy. Please read these terms before ordering. Nothing in them limits any rights you have under federal law or the law of your state that cannot be waived.
Placing an order
You can order with the order buttons on our shop page, by email, by phone or in the shop. After we receive your request we confirm stock and price by email and send a secure payment link. A contract is formed when we email an order confirmation after payment. If we cannot accept your order, for example because an item is out of stock, we will tell you and will not charge you.
Folding knives are sold only to customers aged 18 or older, and we may ask for proof of age at delivery or pickup.
Prices, sales tax and payment
All prices are in US dollars (USD). Prices do not include sales tax or shipping, which are shown before you pay. Maine sales tax (currently 5.5%) applies to orders shipped to or picked up in Maine, and we collect sales tax for other states where required by law. We accept Visa, Mastercard, American Express, Discover, Apple Pay and Google Pay. If a price on our website is clearly wrong, we will contact you before shipping and you may cancel at no cost.
Shipping and delivery
We ship to addresses in the United States only. Shipping methods, rates and timeframes are on our Shipping & Returns page. In line with the FTC Mail, Internet, or Telephone Order Merchandise Rule, we ship within the time we state, or within 30 days if no time is stated. If we cannot, we will tell you and you may cancel for a full refund. Risk of loss passes to you when the carrier delivers the package to the address you gave us.
Returns and refunds
You may return unused items in their original packaging within 30 days of delivery for a full refund of the item price, as described on our Shipping & Returns page. Custom-framed prints and worn socks or hats cannot be returned unless defective. Refunds go to your original payment method within 10 business days of receiving the return.
Warranty
Binoculars sold by us carry a 3-year Natulivo workshop warranty against defects in materials and workmanship, in addition to any manufacturer warranty. If any item arrives damaged or defective, contact us within 30 days and we will repair, replace or refund it and pay return shipping. As required by Maine law, we do not disclaim the implied warranties of merchantability and fitness for a particular purpose on consumer goods.
Limitation of liability
To the extent permitted by law, our total liability for any claim relating to an order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses. Nothing in these terms limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited under applicable law.
Questions and disputes
If something has gone wrong, please contact us first and we will do our best to put it right within 14 days. These terms are governed by the laws of the State of Maine, without regard to its conflict of law rules. Any dispute may be brought in the state or federal courts located in Maine, or in small claims court where you live.
